Wednesday, September 16, 2026 - The Director of Public Prosecutions (DPP) has secured an 11‑year prison sentence against former Kenya Electricity Generating Company Limited (KenGen) employee David Mogire Nyabuti, who used a forged academic certificate to secure employment and unlawfully obtained more than KSh14.9 million in salaries and benefits.
Nyabuti was convicted by the Anti‑Corruption Court after
prosecution led by Naomi Isoe
proved that he fraudulently acquired public property and uttered false documents.
Senior Principal Magistrate C. Okore ordered him to pay KSh14,946,118 in compensation for the
fraudulently acquired salaries, in default of five years’ imprisonment.
He was also fined KSh900,000 for the offence, with a default
sentence of two years.
Additionally, Nyabuti was convicted on two counts of
uttering false documents contrary to Section 353 of the Penal Code.
He was fined KSh200,000 on each count, with a default
sentence of two years’ imprisonment per offence.
The sentences will run concurrently.
The court heard that Nyabuti worked at KenGen as a Craft
Grade III employee from August 2003 until his resignation in September 2018.
Investigations revealed he used a forged KCSE certificate
showing a mean grade of C‑ to secure employment, despite actually scoring a D‑
in the 1994 examination at St Paul’s Igonga Secondary School.
Evidence further showed Nyabuti fraudulently obtained a
disability certificate from the National Council for Persons with Disabilities,
enabling him to enjoy tax exemptions between 2014 and 2018.
He resigned after being asked to present his original academic certificates.
